Cook County Sheriff Eviction Moratorium for 2018 and early 2019

Holi-Delay

The Circuit Court of Cook County entered a General Order 2018-03 on November 19, 2018 setting forth the annual eviction moratorium for Cook County Eviction Order enforcement.  This applies to eviction in Cook County for residential (not commercial) properties only.

The order provides that the Sheriff will stop executing residential evictions from on December 17, 2018 (a Monday which means that the last day evictions will be processed is December 14, 2018) to January 2, 2019.

In addition, as is customary, the Court has ordered that the Sheriff stop executing residential evictions when (a) the outside temperature is 15 degrees Fahrenheit or less on the day of the eviction or (b) whenever weather conditions, regardless of temperature, might endanger the health of those people to be evicted.

Many folks mistakenly believe that no movement occurs in eviction cases during the moratorium but that’s not the case.  The courts remain in session and it is only the Sheriff’s enforcement efforts that are delayed.
